ASAMOAH GYAN’S RAPE AND SODOMY CASE GOES BACK TO ATTORNEY GENERAL

The Prosecutor in the ongoing trial of four suspects, Osarfo Anthony, Ekow Micah, Sarah Kwablah, and Chris Handler, accused of extorting money from Asamoah Gyan, has disclosed to court that the docket of the case has been referred to the office of the Attorney General.

This news came as a big shock to the trial judge and all in court on Thursday, 3rd November, 2016, as the case which is over a year and gradually reaching a closure, has to be referred to the Attorney General’s office.

On the day, Asamoah Gyan’s lawyer, Kissi Agyabeng, was the next witness to testify but was nowhere to be found when the case was called. When the trial judge asked where he was, the Prosecutor said, “My Lord, the docket of this case has been referred to the Attorney General’s office.”

Asked why the referral to the AG’s office without a copy of such a letter to the court, the Prosecutor could not give any answer. The judge therefore asked the Prosecutor to furnish the court with the letter come 24th November, 2016.

Lawyer Kissi’s Scheme

First witness in the case, in the person of Asamoah Gyan’s manger, Samuel Annim Addo, told the court that Osarfo Anthony was doing publications on the Gyan and Sarah Kwablah rape and sodomy allegations last year on a blog, GHBase.com, Osarfo writes for.

A witness in the case, Nii Amarh Armateifio, a worker at 3 FM at TV3, approached Osarfo and asked him to stop the publication and that whatever money the latter’s media house, will lose, they are prepared to negotiate for Asamoah Gyan to pay the publishing cost to kill the story.

Osarfo, insisted the whole proposal be put on paper and signed; something both parties agreed and did. On the day Asamoah Gyan’s manager met Osarfo and gave part of the agreed sum, the police arrested Osarfo and later charged him for extorting money from Gyan.

According to Asamoah Gyan’s manager, Sammy Annim, it is Gyan’s lawyer, Kissi Agyabeng, who directed him on the whole scheme to get Osarfo arrested. To achieve what? Lawyer Kissi could not be in court to explain himself – yet, the case has been referred to the AG.

Possible Reasons For Referring Case To AG

A number of lawyers, who were in court and have been following the case, were equally appalled at the sudden u-turn by the Prosecutor in taking the docket back to the AG. They gave reasons and possible outcomes on this latest development of the case.

“Probably, the Prosecutor is detecting that they can’t win the case or their evidences are not strong enough so they want to withdraw the case” one lawyer explained. Another lawyer also said, “It’s obvious the Prosecutor has no case. I have been following this case since last year. They have just wasted the time of the court and that of the accused.”

They further explained that if the AG does not want to continue the case, it will issue what is called Nolle Prosequi – a term in law which means “will no longer prosecute”. It amounts to a dismissal of charges by the prosecution.

 What Will Be The Fate of The Accused Persons?

The lawyers explained that once the Prosecution discontinues the case, the accused shall be discharged but that does not mean they are free in the true sense of the word- because the case was not determined or judgment was not passed. The AG can reopen the case anytime it so deem fit– because the accused have not been acquitted and discharged.
