IKSON PROPERTIES Agency Limited, located in Tema, has filed a lawsuit against Mercy Agyei, a banker at the Adum branch of Absa Bank Ghana Limited in Kumasi. The agency accuses her of embezzling GH¢75,000 that belongs to the company.
The lawsuit, filed at the Kumasi Circuit Court by Yawson Otoo, Chief Executive Officer (CEO) of IKSON PROPERTIES, seeks an order for the refund of the money, along with interest accrued from November 2, 2023, until full payment is made. It also includes costs, including legal fees.
Plaintiff’s Claim
According to the plaintiff, Madam Agyei completed her mandatory industrial attachment at IKSON PROPERTIES from September to November 2019, where she worked in the marketing department.
The plaintiff alleges that on November 2, 2023, the defendant was assigned the responsibility of collecting GH¢75,000 from Electroland Ghana Limited at Kaase, near Kumasi, on behalf of the company. Madam Agyei reportedly issued an official receipt for the payment but failed to deposit the funds into the company’s account, despite her claims to the contrary.
An audit of the company’s accounts this year reportedly revealed that the specified amount had not been deposited. Following this discovery, a formal complaint was filed with the Asokwa Divisional Police Command in Kumasi. However, investigations have not yet been concluded, preventing a criminal trial from commencing.
Defendant’s Response
Madam Agyei has denied the allegations, asserting that she was no longer affiliated with IKSON PROPERTIES at the time of the incident, as she was already employed at Absa Bank. She claims that the CEO only requested her assistance to collect GH¢70,000—not GH¢75,000—from Electroland Ghana Limited.
Describing the plaintiff’s accusations as frivolous and vexatious, she has urged the court to dismiss the case.
Petition for Prosecution
Meanwhile, Yawson Otoo has submitted a petition to the Attorney General’s Department regarding the delays by the Asokwa Divisional Police in prosecuting the case, which has been under investigation since June 2024.
