Joana Gyan Cudjoe, the parliamentary candidate for Amenfi Central NDC, is permitted to compete in the general elections on December 7 after the commercial division of the Sekondi High Court, led by Justice Gyan Konto, lifted the injunction against her.
This decision follows a chain of accusations that challenged her qualifications. The court’s ruling permits her name and image to be included on the Electoral Commission’s ballot.
The commercial division of the Sekondi High Court, presided over by His Lordship Justice Gyan-Konto, instructed the plaintiffs and defendant to settle their disagreements concerning Joana Gyan Cudjoe’s qualification as the NDC parliamentary candidate for Amenfi Central on November 7.
Five people contested her candidacy, leading to an injunction. According to Edudzi Tamakloe, the lawyer for the first defendant, the court has set a hearing for November 11, but efforts to reach an out-of-court settlement were not successful.
On November 11, both sides came at 8:50 am, before the 9:15 am set hearing. Justice Gyan-Konto was ready to issue a decision as scheduled.
The National Democratic Congress (NDC), serving as the second defendant, contended that their party framework conflicts with the public constitution, while opposing the plaintiffs’ request for an injunction.
Nevertheless, the attorney for the plaintiffs argued that the question of Joana Gyan’s eligibility is still unanswered. At first, the plaintiffs sought a restraining order to halt Joana Gyan’s inclusion on the ballot, but it was rejected.
The primary concern currently is the request to lift the injunction questioning Joana Gyan Cudjoe’s qualifications.

Justice Gyan-Konto of the Sekondi High Court has ruled in favor of Joana Gyan Cudjoe, lifting the injunction that formerly barred her name and image from being displayed on the electoral commission’s notice of poll. This choice follows a spirited debate among attorneys representing both the plaintiffs and the defendants.
Consequently, the electoral commission must now promptly include Joana Gyan Cudjoe’s name on the notice of poll, allowing her to participate in the forthcoming elections.
The attorney representing the first defendant, Edudzi Kudzo Tameklo, stressed in an interview that since the injunction has been removed, the Electoral Commission must act correctly by including Joana Gyan Cudjoe’s name and photo in the notice of poll
“We would like to extend our gratitude to the court for its decision. We appreciate the Electoral Commission’s representative presence in court, as they are now aware that the injunction has been vacated”.
“The basis for Joana Gyan Cudjoe’s disqualification was the injunction order, which is no longer valid. We urge Jean Mensa, the Electoral Commission Chairperson, to take the necessary steps to ensure Joana’s eligibility is reinstated, upholding the principles of fairness and transparency,” he cautioned.
Joana Gyan Cudjoe, the parliamentary candidate for Amenfi Central representing the National Democratic Congress (NDC), is encouraging her supporters to stay composed and persist in their campaign activities despite the recent obstacles.
After the Sekondi High Court’s ruling to lift the injunction on her candidacy, Joana is now eligible to participate in the forthcoming elections.
