COURT THROWS OUT NDC INJUNCTION, ORDERS EC TO RE-COLLATE ABLEKUMA NORTH ELECTION RESULTS

The Electoral Commission (EC) has been instructed to re-collate the parliamentary election results for the Ablekuma North Constituency in the Greater Accra Region, notwithstanding the objections raised by the National Democratic Congress (NDC). According to broadcaster Serwaa Amihere, a court ruling issued on Friday, December 20, 2024, mandated the EC to re-collate the results for the constituency and to officially declare the winner anew.

On December 10, 2024, the EC initially announced the candidate from the NDC, Ewurabena Aubynn, as the victor, surpassing Nana Akua Owusu Afriyieh of the New Patriotic Party (NPP), who is a former Member of Parliament and currently serves as the Deputy Chief Executive of the Coastal Development Authority. However, the EC subsequently retracted the declaration of Ewurabena Aubynn as the Member of Parliament-Elect for the constituency, citing the need to re-collate the results.

The Chairperson of the Commission, Jean Mensa, clarified that the declaration of Ewurabena Aubynn as the winner was made without the inclusion of results from 62 polling stations.

“In the Ablekuma North constituency, 219 polling station results were used to declare a winner instead of 281 polling station results. The Commission would not uphold that declaration,” she said at a press conference on Thursday.

The National Democratic Congress (NDC) has initiated legal proceedings against the Electoral Commission (EC) concerning the re-collation of results in five constituencies where their parliamentary candidates were previously declared victorious, including the Ablekuma North Constituency. The action, filed on Monday, December 16, 2024, seeks an order for judicial review encompassing Declaration, Certiorari, Prohibition, and Injunction.

In this legal action, the NDC, identified as the first applicant, asserts that the declarations made during the December 7 elections in favor of Faustina Elikplim Akurugu (Dome Kwabenya), Baba Sadiq (Okaikwei Central), Ewurabena Aubynn (Ablekuma North), Ebi Bright (Tema Central), and Samuel Aboagye (Obuasi East), who are the second, third, fourth, fifth, and sixth applicants respectively, should not be subject to re-collation and re-declaration.

The NDC again submitted that the EC, following their earlier declarations, “has become functus officio and therefore cannot re- collate, recount, and re-declare the results of the already declared election results in the stated constituencies.”

The party is requesting a court order to prevent the respondent from re-collating, re-counting, and re-declaring the parliamentary election results that have already been collated and declared for the constituencies of Dome Kwabenya, Okaikwei Central, Ablekuma North, Tema Central, and Obuasi East.
