Ghana’s Supreme Court has dismissed a case challenging the Food and Drugs Authority’s decision to ban celebrities from endorsing alcoholic beverages.
The FDA in 2015 banned Ghanaian celebrities from advertising alcoholic beverages. According to the regulator, the ban was in adherence to a World Health Organisation policy.
It also said the decision was part of efforts to protect children and prevent them from being lured into alcoholism.
Mark Darlington Osae who is the manager for Musicians Reggie N Bollie was of the view that the directive was discriminatory and unconstitutional and therefore filed a suit at the apex court seeking interpretation and injuncting the FDA’s directive.
But in a majority 5-2 decision the Supreme Court presided by Chief Justice Gertrude Torkonoo upheld the constitutionality of the directive.
