JUSTICE SREM SAI CRITICIZES EC’S VOTE RECOUNT, HIGHLIGHTS LEGAL CONCERNS

Private Legal Practitioner and Law Lecturer, Justice Srem Sai, has voiced strong criticisms of the Electoral Commission’s (EC) decision to recount votes in nine constituencies, seven of which were later redeclared in favor of the New Patriotic Party (NPP).

Speaking on the Citi Breakfast Show on Monday, December 23, Sai questioned the legality and transparency of the recount process, drawing attention to what he described as a departure from proper legal procedures.

“There were situations where all the parties agreed that there were mistakes, and that is without dispute. However, when there is dispute, the law is that the declaration has to be gazetted before one can challenge the outcome in court,” Sai explained, emphasizing the legal framework that governs electoral disputes in Ghana.

He further distinguished between mistakes and disputes, arguing that the current situation falls squarely in the latter category. “There is a difference between a mistake and a dispute. What we have in the current situation is a dispute. So long as one person is saying A and the other is saying B, it is a dispute,” Sai asserted.

Sai expressed surprise at the EC’s handling of the matter, stating, “There is a school of thought that the EC can correct its own mistakes, but what we see here is not about correcting mistakes; it’s about resolving disputes.”

The controversy has ignited widespread debate among political analysts, legal experts, and citizens, with many questioning the transparency of the EC’s recount process. Opposition parties have expressed frustration, accusing the EC of circumventing established legal processes.

“When you allege lawlessness, as the EC has done in these situations, or illegalities, there is no proper avenue for resolving an illegality outside of the court,” Sai pointed out, emphasizing the judiciary’s role in resolving such contentious issues.

The EC’s actions have raised broader concerns about the integrity of Ghana’s electoral processes, prompting calls for greater accountability and adherence to the rule of law.
