The injunction acquired from the High Court at Sogakope to stop the coronation of Torgbiga Wenya III and Mamaga Abui Buiekpor II was frozen by lawyers of the Loafe and Tovie clans leadership and their allies yesterday, Wednesday 10th August 2022. Samuel Kissiedu ESQ, lead counsel for the Loafe and Tovie clans’ leadership and their allies filed three motions:
There is a motion of stay of execution of the Injunction Order and to set aside the set order, all the processes and the proceedings of the High Court at Sogakope on the basis that it was granted erroneously and without jurisdiction. With such high-ranking installations, only the Regional House of Chiefs has jurisdiction to determine any Chieftaincy matters of Paramount Status.
The Supreme Court, which has the authority to supervise the High Court, has been called upon to cancel the said injunction order.
A prohibition to restrain or injunct the High Court at Sogakope or any other High Court from entertaining any other processes in respect of the Chieftaincy of Dutor Togbiga Wenya III and Mamaga Abui Buiekpor II. To that extent, the planned coronation activities are coming on the 13th of August as scheduled.
9The lawyers argue that the High Court has no jurisdiction to decide on this chieftaincy issue or any chieftaincy issue for that matter. According to them, chieftaincy issues are handled by the various houses of chiefs in the country. They pointed out that opponents going to the High Court at the last minute to acquire an injunction when they could have sought legal redress four months prior was not only a mischievous move but a calculated attempt by them to stop the coronation.
The date for the first hearing at the Supreme Court is Tuesday, 8th November 2022, which is after the coronation. Therefore, all plans for the coronation are going ahead as scheduled and publicised. While parts of the Coronation rites will be performed at the Hogbe Park in Anloga, Torgbi Wenya’s final resting place, the main event will take place at Tegbi Beach, Ashiata Ocean View, as follows:
Friday Evening 6 pm – Coronation Concert
Saturday Morning 9 am – Coronation Ceremony
Saturday Afternoon – Reception.
