HIGH COURT ORDERS ARREST OF DIRECTOR GENERAL OF GHANA POLICE CID AND LEGAL UNIT HEAD

Reports reaching our desk reveals that the High Court in Accra has issued a bench warrant for the arrest of the Director General (DG) of the Criminal Investigation Department (CID) of the Ghana Police and the DG of the Legal and Prosecution Unit of the Ghana Police Service. The warrant follows their failure to appear in court for contempt proceedings.

According to starrfm.com.gh, the court’s decision stemmed from an application filed by Sureword Global Outreach, seeking an order for the respondents to release a vehicle bearing registration number GN2925-20 to the applicant. Despite repeated court orders, the respondents had allegedly “blatantly refused” to honour the directives.

During the court session held on Monday, April 15, 2024, Counsel for the Application, Abraham Arthur, moved an application for committal for Contempt against the CID boss and the DG of the Legal and Prosecution Unit for their failure to comply with the court’s orders.

Arthur stressed that the respondents did not show up for the hearings, even though they had been given explicit directions to appear on that day.

The presiding judge, Justice Lydia Osei Marfo, responded to Counsel Arthur’s statement by expressing her disgust with the respondents’ disobedience of the court’s orders in spite of having been given enough of opportunity. After stressing that no one is above the law in Ghana, a bench warrant was issued for their arrest.

Judge Marfo emphasized the evidence showing that despite the Inspector General of Police (IGP) receiving court orders, the respondents continued to disobey the instructions.

She restated that the court needed to uphold the law in the end even though it had shown the public officials enough decency.

This has happened in response to several cautions that the court has given. The Inspector General of Police was instructed by the court to make sure the respondents showed up on March 19, 2024, with a warning that noncompliance could result in a bench warrant. The respondents allegedly persisted in disobeying the court’s orders in spite of this.

According to the case history, on January 29, the Achimota District Court granted Sureword Global Outreach’s motion to be released from their impounded car. Sureword Global Outreach filed for contempt proceedings because the respondents allegedly refused to follow the court’s direction.
